       Speech 1989.11.14
       From: Foss P
       To: Parliament WA
"I am concerned about the public concern - and it is a concern that I
share - that changing the law may indicate a change in attitude in this
parliament.... I have sought to put on the Notice Paper a preamble. A
preamble is a very important part of an Act, and that I have been urging
the use of preambles in this parliament because preambles state better
than other ways the policy of an Act. I realise the public perception is
not necessarily the same as the perception of a judge or a court. The
       preamble reads -

WHEREAS, the Parliament does not believe that sexual acts between
       consenting adults in private ought to be regulated by the criminal code;
AND WHEREAS, the Parliament disapproves of sexual relations between
       persons of the same sex;
AND WHEREAS, the Parliament disapproves of the promotion or
       encouragement of homosexual behaviour;
AND WHEREAS, the Parliament does not by its action in removing
any criminal penalty for sexual acts in persons of the same sex wish to
       create a change in community attitudes to homosexual behaviour;
AND WHEREAS, in particular the Parliament disapproves of persons
with care and supervision or authority over young persons urging them
to adopt homosexuality as a lifestyle and disapproves of instrumentalities
       of the State so doing....

I wish to go further than that , because two areas need to be dealt with,
and for that reason I have proposed a new part II to this Bill.... I have
chosen the age of 21 as the age of consent for males for particular
       reasons....

the following statement from the Gay Reform Group - 'Homosexuals, as
much as others in the community, simply seek to be able to get on with
their lives and to be able to enjoy to the maximum extent possible, all that
life has to offer. They wish to maximise their potential to contribute to
society through their work and other activities. They do not seek to turn
people into homosexuals or to bring about the destruction of the family.
Homosexuals simply want to be treated with the same dignity and respect
that is accorded other members of the community and to live their lives free
from the guilt and fear presently experienced.' This encapsulates the intent
of the legislation before us. I commend the Bill to the House."

       Mud Map 1990.03.14
       From: Weir G
Expected time line for law reform. Based on assumptions a) reform
would be brought in before the end of the year; b) The Criminal Justice
Commission will only fleetingly deal with it (Refer Bingham statements
on gay law reform a low priority); c) Major substance of the inquiry
will be dealt with by the Parliamentary Committee; d) the constraints
of the set parliamentary sittings and when the parliamentary inquiry was
likely to hold it major investigations. Give or take a few weeks here or
there it was reasonably accurate. Mud map also outlines the gay community
campaign except for activities organised by the Gay Pride Collective for
gay pride week in June. (Personally this mud map is one of the most
significant documents in the collection, for it was at this stage that we
could say with some degree of confidence what was to be expected as the
year progressed. This was a confidence shared by Stephen Cox at meeting
      held to discuss the map.)

       Reports 1990.03.26
       From: Chairperson QAGLR
       To: Members QAGLR
"Inaugural Annual Report 1989/90" - Chairperson's Report -. Nick Ward
stated in part, "As we now approach the reality of legal reform and protection,
our focus must move forward. In other places, both in Australia and around
the world gay law reform has been followed by an apathy of contentment,
inevitably followed months or years later by violent backlash. In being one
of the last places to achieve gay law reform we have the benefit of being able
to learn from the mistakes of others. We must use this next year to make
an unprecedented assault on community attitudes and awareness, through the
media, the arts, and through the pride and confidence of each of us individually,
as well as through the legislature. After law reform these efforts must accelerate.

       From: Chairperson (Past) QAGLR
       To: Members QAGLR
AGM "Past Chairperson's Report" - Michael Browne in part stated, "One of
the most difficult time for QAGLR was the determination of the Association's
stance during the 1989 state election campaign. Following a highly successful
demonstration and press conference in October, spirits among the members of
the association were very high. Our demonstration was our most visible
expression of gay pride and our enthusiasm was heady. With this great success,
the following debate was particularly dispiriting for many. To march or not to
march again. This was the Question!... The wisdom of that decision is still being
       debated."  Headings contained in the report: Beginnings, The Constitution;

       Report 1990.03.26
       From: Deputy Chair QAGLR
       To: Members QAGLR
AGM 1990. Max LeMarchand stated, "Our next organisational effort was
the Gay Summit which came about because the Labour Party asked us not
to have any more street marches before the election and a majority of
QAGLR members voted for this proposal. I suggested we hold a summit
of gay groups to start getting Brisbane's gay community to work together
to achieve law reform... The summit was a huge success... I was again
disappointed that our membership did not support us in great numbers."

       From: Secretary QAGLR

Annual General Meeting. Colin Crosbie said, "... we need to ensure that
sort of (West Australian) legislation does not arise here due to it's most
recent precedent status: we must be vigilant of what the Government
tries to pawn off as their appeasement to the Gay community. If QAGLR
is willing to assist in the mobilisation of the Gay Community and not rely
on the motions of the new ALP government alone, then I look forward
       to working with the Association...."

       Report 1990.03.26
       From: GW QAGLR Campaign Committee
       To: Members QAGLR
Greg Weir wrote, "The committee was formed in the beginning stages
of the State election campaign last year. Initially its brief was to organise
community support for gay law reform and to counter the political flack
which surrounded the National Party Campaign. Over the summer season
the committee developed proposals for activities which sought to develop

Regarding activities on campus and the request I made, in January, to
Nick Ward that we should only aim for victories and not for defeats,
not unnecessary defeats during the law reform program. The referendum
was such a defeat and one which had some influence on the younger
members of the ALP right wing. Also campaign energies could be put
to better use over this time.

Regarding background to investigations of CJC. The research officer
contacted the QAGLR literally as the furniture was being moved into
the office. This gave me the impression that their investigations were
to be only superficial and that the Parliamentary Committee would be
the more important group to address our efforts. The chair of the
Commission had already said that he regarded the issues as a 'low priority'

of Homosexual Conduct and Criminal Law - The QCCL is of the view
that two very important principles should be applied when considering
to what extent the criminal law should deal with sexual conduct. These
are: 1. that what adult persons do with the consent of each other in private
is of no concern to the criminal law; 2. that the criminal law should not

"Refusal of homosexuals to AIDS test" Analysis of Western Australian
legal changes. "If you look at the terms of the Act you will see that it
enshrines as official government policy prejudice against, and antagonism
and intolerance towards homosexuals and lesbians. The introductory
wording of the statute, the Preamble, includes: 'Whereas the Parliament
disapproves of sexual relations between persons of the same sex; AND
WHEREAS, the Parliament disapproves of the promotion or
encouragement of homosexual behaviour; AND WHEREAS, the
Parliament does not by its action in removing any criminal penalty for
sexual acts in private between persons of the same sex which seeks to
create a change in community attitude to homosexual behaviour....'
So homosexuals in Western Australia may well be now worse off than
ever before, because they cannot predict what sort of action may be
taken against them under the law as it now stands"
