"I seek the co-operation of the Ministers and officials in ensuring adherence to Cabinet
procedures and high standards of public conduct... I welcome the publication of the
Cabinet Handbook as a step in the consolidation of open and accountable government
in Queensland," W.K.Goss. The handbook on page 96 states regarding Ministers of the
Crown, ".... Administrative arrangements determining the role and responsibilities of
Ministers are established from time to time by the Premier (see page 96).The Premier
is the Leader of the Government and the Chair of Cabinet. The Premier's authority rests
upon political conventions together with a capacity to maintain the support of the
Parliament. That generally requires the support of the Ministerial colleagues and the
political party which the Premier leads..." On page 11 it states, "In respect of the policy
development and co-ordination role, it is the responsibility of the Director-General of
the Office of Cabinet to advise the Premier, and through the Premier, the Cabinet, on the
co-ordination of the policy development and implementation program of Government."
This document is a vital reference in understanding the dynamics of policy making by
the Labor Government.

Personal approach to Anti-discrimination campaign. A number of other people
in the lesbian and gay community had stated a professed interest in, and a
preference for, working on this area of reform during 1990. Therefore I thought
that it was appropriate that they should work on this area. Besides I was
exhausted. Little had been done however by mid-year which would substantially
change the political agenda, so my original resolve was watered down.

legislation is now in its 30th draft, but he still expects to have it introduced
into parliament by the end of the year. Meanwhile Mr Wells is adamant
the legislation won't address the question of discrimination on the
grounds of sexual preference. Civil rights campaigners and homosexual
groups say the legislation will be meaningless if it doesn't cover sexuality,
but Mr Wells says the government has already met it's obligation to gay
groups... 'The Govt's attitude is that this is not an issue. The legislation
that we've introduced concerning that particular group of people is in place
and we're not proposing to change that. There's a limit to the number of times

30-drafts, the Government believes it's close to a formula that will be
acceptable to most community groups. Chart: "The legislation will make
it an offence to discriminate on the grounds of sex, race and marital status,
but there've been problems for the Govt. over whether it should cover the
question of discrimination on the grounds of sexual preference, such as
occurs with homosexuals in the workforce. Gay groups and civil libertarians
say that without a sexual preference clause the legislation will be worthless.
But it's believed the Govt. is considering a proposal which would make it
illegal to discriminate against anyone who engages in what's called lawful
sexual activity. Such a proposal would now cover homosexuals in Qld.
on yet another front. It's believed the Govt. legislation won't affect the
operation of exclusive clubs offering all-male members.

Terminology used by Premier. The ABC AM Current Affairs Program
had a heated debate between Terry O'Gorman (Queensland Council for
Civil Liberties) and the Premier (Wayne Goss). During this debate the
premier said that the legislation would contain "sexuality". This seemed
to indicate that there was possibility of changing the terminology to a
more inclusive term like sexuality. It was thought that consultative
process over the draft legislation implied that the government was not
committed itself to 'lawful sexual activity.' This I learnt later was not to
the case.

The format for responses I believe were significant in the formulation of
clause 24 for the final legislation. The original format was taken from the
Law Reforms Commissions questionnaire on changes to the Queensland
Criminal Code. This format was based on the premise that organisations
possessed the skills to draft legislation adequately and accurately enough
to reflect their specific concerns. I believe this was an overestimation
of the skill base of organisations which were the 'target group' in the
consultative process. Also all responses were classified to stop as a
Ministerial document so that they are regarded in a similar way to cabinet
documents. (see "Cabinet hand book" Document No......... in this archive
for details of this classification). I learnt later that the group which
recommended clause 28 did not expect it to be applied across the board,
but only to their own institutions.

"Anti-Discrimination Bill 1991...Clause 7(l) sets out lawful sexual
activity as a prohibited ground of discrimination. This will protect
not only homosexuals, but also heterosexuals who might be discriminated
against because of sexuality., for example, a women who is discriminated
against in employment on the grounds of a belief (whether true or not) that
she is or was promiscuous. (pg 5)....Clause 28 permits discrimination on
the grounds of lawful sexual activity only in the work area involving the
care and instruction of minors. The discrimination is only lawful if it is
reasonably necessary to protect the physical, psychological or emotional
well being of the minor. As work is defined in clause 4 to include both
voluntary and unpaid work, this exemption will also cover the situation of
a boy scout leader, choirmaster or coach of a junior sporting team. (Pg. 8)"

Media Campaign to get amendment to Clause 28 (GW). There was little
left but to mount a high profile media campaign. The government in its
quest to please all sides of the politics was to have introduce Bills which
were 'progressive' and 'regressive.' In the end pleasing not one at all.
In this instance it was clause 28, which it sort to highlight. I therefore
approached the unions most affected by clause 28 and sort a media
campaign with ran over the weekend and culminated in on a the Monday.
It was after this that the Attorney General sought a meeting with the unions
(Independent Teachers, the Queensland Teachers Union and the
Miscellaneous Workers Union). The front page coverage of that Monday
media exposure is not contained in this archive collection. Much to my
disappointment.

Sourced of Clause 28. In the concluding day of the past week I was able
to establish were the clause had originated. The group which had proposed
it only wished to have exemption from the institutions which they controlled
and did not envisage that it should be make universal. This had apparently
been misinterpreted by the Attorney General's Department, and given the tag
of clause 28 (Refer British legislation for a pun ill intended). This to me
reflected very poor policy development processes. It would seem appropriate
for the Government to have sort clarification on this as it affected a large number
of people. But perhaps it was a tactical political decision to appease the
'red-necks.' Refer note on debate with Attorney General - mid 1992. (Only

There were a number of community briefings held by the Human Rights
Commissions. These were given to employee and employer groups, community
organisations. I attended one held for the lesbian and gay communities at the
Trades and Labor Council building. It was gratifying to see all sections of the
communities making use of the briefing and promising to use the legislation to
advantage. This was particularly true of many of the younger ones.

processes 'Law reform and anti-discrimination legislation are important but
there is more to social change that changing laws. There are a number of lesbian
and gay organisations working for long-term social change by developing strong
lesbian and gay culture and challenging negative attitudes to homosexuality. I
remember being on a bus on day and just being overwhelmed by the billboards,
newspaper articles, advertising and everything that blared heterosexuality at me.
I'd like to say to heterosexual people that I understand there is an enormous social
conditioning process in relation to sexuality but that respect and understanding
come from interaction with people and listening and learning about different
lifestyles. It would be good if people opened their minds and accepted diversity
in lots of things including sexuality."

The Friday following the Defence Force decision on gays and lesbians,
Senator Margaret Reynold contacted me at home wanting to know what could
be done. She said see would be willing publicly state that she would ask the
Caucus to consider the decision. I arranged a low key, but effective national
media interview for the Sunday. It just snow balled over the coming week.
A predictable outcome. Margaret said that the then Attorney General, Michael
Duffey congratulated her on her stand. The initial and subsequent responses to
her stand, and how the issue developed, showed how change in these areas
had developed a diverse and effective momentum of their own. A far cry from
vanguard actions by insolated groups so evident in the early days of the 'gay
movement'. The study of this policy change would be worthy of study. (Note

"Under the Sun' Outline of some cases taken up by the Commission.
"Sexual Preference - A man applied for a job with a major north
Queensland hotel and gave the personnel manager a referee's name.
The referee later told the applicant that the hotel had asked about his
sexual preference. The man lodged a complaint with the Commission
and the matter was conciliated with the payment os $4,500 compensation"
(Pg6.). "Gay teacher - The other interesting case from South Australia
was a complaint by David Jobling that he was dismissed from his
position as a teacher with the South Australian Education Department
when they became aware he was both gay and HIV positive. The South
Australian Equal Opportunity Tribunal found that Mr Jobling had been
discriminated against and awarded approximately $60,000 in damages
which included lost wages and general damages for humiliation. The
Queensland Anti-Discrimination Act provides for complaints to be made
on the grounds of lawful sexual activity and impairment which would
include a person's HIV status."
